Hybrid Work Policy for Indian SMEs: A Simple Framework

Many small companies in India slide into hybrid work. One manager approves two home days. Another team asks for the same. Within a few months, nobody can say what the rules are. A written hybrid framework fixes that. In this guide, we walk through a simple hybrid framework built on five decisions, along with the legal points and office space questions that come with it.

What a Hybrid Framework Is and Why SMEs Need One

A hybrid framework is a short set of rules that says who works where, on which days, and how the company tracks results. It turns scattered approvals into one policy that managers and employees can follow.

SMEs may feel the effects of unclear hybrid rules more quickly because they often have fewer HR resources and less administrative capacity. One unclear rule can turn into weeks of back-and-forth. Informal approvals can also lead to unequal treatment, which hurts trust and employee engagement. On the cost side, paying for consistently underused desks can increase occupancy costs, especially when peak attendance is predictable.

Where the Law Fits In

India does not have a standalone law that gives employees a universal right to work remotely. Hybrid work is generally governed through the employment contract, company policy, applicable state Shops and Establishments requirements and the four labour codes, subject to the business, establishment and employee categories covered by each provision.

The four labour codes are the Code on Wages, 2019; the Industrial Relations Code, 2020; the Code on Social Security, 2020; and the Occupational Safety, Health and Working Conditions Code, 2020. The four labour codes were made effective from 21 November 2025.

Not every provision applies in the same way to every SME. Applicability depends on the state, the type of establishment, the category of employee, workforce thresholds and the relevant rules or notifications. Requirements may cover working hours, overtime, attendance and wage records, leave, workplace safety and employee welfare.

The 5-Decision Hybrid Framework

Each decision below can become one section of your policy. Work through them in order.

Decision 1: Pick Your Hybrid Model

Start with the model, because every other rule follows from it. Indian SMEs commonly consider four models.

If you are unsure, we suggest starting with a fixed hybrid framework. In our view, it is the easiest model to explain and track. You can loosen it later.

Decision 2: Decide Who Is Eligible and How Approval Works

Not every role can work remotely. Reception, warehouse and many client-facing jobs often need a physical presence. Write the eligibility rules in plain terms. Role type, probation status and performance standing are common ones. Then name who approves requests, usually the reporting manager with an HR review. Keep approvals in writing, not in chat messages.

Decision 3: Set Attendance Office Rules and Core Hours

Anchor Days

Pick one to three days when the team meets in person. Some teams choose Tuesday to Thursday as anchor days, but the best choice depends on client schedules, team dependencies and office capacity. Anchor days give collaboration a fixed home, and they make planning easier.

Core Hours

Core hours are the agreed window when employees are expected to be reachable, for example 10 am to 4 pm. Outside that window, people can shape their own day.

Exceptions and Records

List how exceptions work: illness, travel, client visits. Then decide how you record office days and remote days. A simple app or shared sheet works for a small team. What matters is accuracy. These records may support payroll, leave administration, overtime review and workforce planning. Restrict access to authorised personnel, and keep records only for as long as required by law or company policy.

Home working also blurs the end of the day, so state that overtime requires prior approval under company policy. Make clear that applicable statutory overtime obligations may still apply where an employee performs qualifying overtime work.

Decision 4: Cover Tools, Security and Costs

Equipment and Internet

Say what the company provides, such as a laptop, and what the employee provides, such as broadband and power backup. If you reimburse internet or setup costs, state the amount and the proof needed. Set the figures to fit your budget.

Data Security

Remote work moves company data onto home networks. We recommend security controls such as device passwords, a VPN for company systems, multi-factor authentication and prompt reporting of any suspected breach.

The Digital Personal Data Protection Act, 2023 may be relevant when you collect or monitor attendance, access-control, device, login or other employee data. Employment-related processing may be permitted in certain circumstances. Even so, employers still need appropriate safeguards, lawful processing practices, breach response, grievance handling and retention controls, as applicable. The Act has a phased commencement structure, so confirm the provisions and related rules currently applicable to your business before finalising the policy.

Decision 5: Measure Performance and Review the Policy

Performance Measurement That Works

Hours logged in or time at a desk may not fully reflect performance. Performance measurement works better when it tracks outcomes: goals met, quality of work and deadlines kept. Agree on targets at the start of each quarter and review them in regular one-to-ones.

Protecting Employee Engagement

Remote staff may feel disconnected from the team. Employee engagement tends to hold up when managers run regular check-ins, share the same information with remote and office staff, and use anchor days for real teamwork rather than status updates. A short pulse survey every quarter can show early problems.

Review on a Schedule

Run the first version as a 90-day pilot. Then look at attendance data, output and employee feedback. After that, update the hybrid framework at least once a year.

Plan Your Office Space Around Your Hybrid Framework

Your policy affects how many desks you need. Some SMEs sign a lease before writing the policy, which can leave them paying for more space than they need.

Do the Seat Math

Take your headcount, multiply it by the office days per person each week, and divide by five. Say you have 40 people, each in the office three days a week: 40 × 3 ÷ 5 = 24 people in the office on an average day. This assumes attendance is evenly distributed across the week.

Many teams use a planning buffer, such as 10%, depending on visitor volume, meeting-room needs and peak attendance. It is a planning assumption, not a universal standard. With a 10% buffer, 24 becomes about 27 desks when you round up.

There is one catch. If everyone comes in on the same anchor days, you may need close to 40 desks on those days. So your anchor day choice changes the numbers.

Fixed Lease or Flexible Space

A long lease may suit a team with steady, predictable attendance. If your headcount or office days may change in the next year, shorter and flexible terms can lower the risk. Compare the full monthly cost, including maintenance, internet and power, not just the rent.
